How long does one have to file a lawsuit after a car accident?

While the immediate effects of an automobile accident in Florida are often readily seen: two or more cars on the side of the road with significant damage, injured individuals being transported to the hospital in an ambulance, and police on the scene, the after effects of a car accident can take months or even years to manifest. Perhaps you have an injury that never healed well, or you've had to spend a long time in the hospital and endured a long period of rehabilitation following that.

Even if the accident occurred a long time ago, circumstances may come up in which an person wants to file a lawsuit against the individual who caused the accident. However, did you know that there is only a certain period of time in which an accident victim can file a personal injury lawsuit?

This period of time is known as the "statute of limitations." While the statute of limitations varies based on the type of case being pursued, in general, a personal injury lawsuit based on negligence (but not wrongful death) in Florida must be brought within four years (a wrongful death lawsuit must be brought within two years.)

It is important to be aware of the statute of limitations period applicable to your case, because once it passes you may no longer be able to file a lawsuit. It can take professional advice, however, to determine when the statute of limitations starts running. Sometimes it is the date the accident took place, while other times it starts when one discovers he or she has been harmed.
