Family could file wrongful death claim against intoxicated driver

Those who are accused of DUI typically face serious consequences if convicted. A former law enforcement officer was recently arrested in Florida after allegedly hitting five children with his vehicle while intoxicated. The family of one of the children may consider filing a wrongful death lawsuit after their son died due to the fatal injuries he received in the collision.

The accident occurred at a school bus stop just after several children had gotten off the bus. Authorities state that the man who allegedly caused the collision ran off the road, hitting five children with his car. The sheriff's deputy who was first on the scene reported that the man then hit another car less than a mile down the road before stopping.

The five children were injured and taken to the hospital where one child tragically died from the injuries he suffered. The woman driving the other car was also injured. Seven hours after the accident, the man agreed to take a breath test and registered nearly twice the Florida legal limit. A total of 11 charges have been brought against the former officer, including DUI manslaughter and vehicular homicide.

Even though the former officer has been arrested and charged with criminal offenses, the deceased victim's family may still file a wrongful death claim against him in civil court. If their claim is successful, they could be awarded monetary damages to help pay for medical bills, funeral costs and any other financial expenses related to the crash.
