Motorcycle accidents likely when drivers are under the influence

Just as drivers of traditional vehicles such as cars and trucks have a duty of care to their passengers, so too do motorcyclists. When drivers are negligent and traffic laws are broken, motorcycle accidents are much more likely to happen. A recent accident in Florida left a biker injured and took the life of a woman riding with him.

Few details of the crash have been released at this time. However, officers said that the man driving the motorcycle apparently lost control of the vehicle, which led to the crash. Both the driver and a female passenger were ejected from the bike. The accident, which occurred slightly past 4 a.m., is still under investigation.

Tragically, the female passenger died at the scene as a result of her injuries. The driver suffered injuries as well, though they were not life-threatening. Reports do not indicate whether either person was wearing a helmet. The man has since been arrested and charged with DUI manslaughter.

Even when criminal charges are filed against an alleged negligent driver, the family of a deceased victim may still be entitled to file a wrongful death claim in civil court against the driver. If the driver is proved negligent in civil court, claimants may then awarded monetary damages that can help pay for costs such as medical bills, funeral costs and any other expenses related to the incident. Those who have lost loved ones to motorcycle accidents can speak with experienced Florida personal injury attorneys to learn more about these claims and to obtain assistance in filing them.
