Premises liability: Woman falls and suffers back injury

All Florida residents are responsible for ensuring their own personal safety. Unfortunately, there are instances that the negligence of another can result in harm to a person, no matter how careful one may be. Negligence of another could be minor, but sometimes it may result in serious long-term injury and ongoing medical treatment. One woman in another state has claimed in a premises liability lawsuit that a liquor store's negligence is the result of her injury and chronic pain.

The woman entered a liquor store on a rainy day and fell upon entering the store. Reportedly, she immediately sought medical treatment due to pain her back. Her pain continued upon discharge from the emergency room, leading her to seek further treatment from specialists. Ultimately, she required a complicated spinal surgery, and her pain has persisted despite treatment.

Her lawyers have argued that the woman's pain prevents her from leading a normal life and that she no longer has the ability to earn a living. Apparently, the defense countered and claimed that the woman may have had a previous dependence on narcotics that would have prevented her from working. The jury is expected to make a decision in the case soon.

Premises liability lawsuits can be complicated, as in this woman's case. Although lawsuits are complex, a monetary award could make a big difference for some injured victims by providing financial relief for any related past, present and future medical treatment.
