Wrongful death lawsuit filed against driver, company and Disney

Most would think that driving violations, fatigue, medical conditions and medications that would cause sleepiness would prevent someone from driving professionally. One tragic wreck in Florida is revealing that unfit drivers may remain on the road behind the wheel despite safety concerns of a driver. A wrongful death lawsuit has been filed against a driver, his employer and the company, Disney, that ordered the oil he was hauling for their combined involvement in the summer accident.

The accident resulted in multiple deaths and serious injuries to those involved. The band Adrenaline Mob and its tour manager Janet Rains, also known as Jane Train, were traveling along Interstate 75 in Marion County. As the band's vehicle was being repaired on the side of the interstate, a tractor-trailer crashed into it. A fire erupted as a result of the crash and several of the band members were seriously injured. Janet Rains and one of the band members did not survive their injuries.

Allegedly, the accused tractor-trailer driver had numerous strikes against him that should have prevented him from operating a vehicle. Records indicate that he had more than 30 traffic violations the month prior to the accident. Additionally, the driver's medical history and medication list indicated he was unsafe to drive. Reportedly, the driver had also logged too many hours behind the wheel and was likely too tired to have been driving.

The wrongful death lawsuit has been filed by Janet Rains' estate and some of the other injured band members. Filing a lawsuit against a truck company can be tricky and complicated. Experienced attorneys in Florida have the knowledge and experience to file a lawsuit in civil court on behalf of family members of deceased victims. A lawsuit will not bring back a loved one, but any compensation that could result from a lawsuit could assist the family in any related unexpected expenses.
